Terms and conditions
1. Acceptance and scope
These terms govern access to and use of tlacatisurrogacy.mx, as well as initial guidance offered under the Tlacati brand through WhatsApp, Facebook, Instagram or email. By using the site or starting a conversation, you accept these terms. Personal data processing is described separately in the Privacy notice.
If you disagree, you may stop using the site or end the conversation at any time. Exploring information does not oblige you to continue with Tlacati or any third party.
Operation under the Tlacati trade name is the responsibility of Chenet Marcel Carreño, with an address in Mexico City and contact email gestantes@tlacatisurrogacy.mx.
2. Nature of the service
Tlacati is an independent information and referral channel. Its role is to explain, in plain language, the stages and general requirements commonly involved in surrogacy, answer initial questions and, if requested, explore a referral to an independent agency, clinic or program operator.
The content and conversations:
- Do not constitute medical care, diagnosis, treatment or clinical assessment.
- Do not constitute legal, psychological, tax, financial or insurance advice.
- Do not create an employment, representation, partnership, agency or exclusivity relationship.
- Do not replace review of contracts, consent forms, policies, budgets or instructions from authorized professionals.
When a decision may affect your health or rights, you should consult a professional with a current license or authorization directly and review the specific program's conditions in writing.
3. Requirements, assessments and decisions
Published requirements are a starting point and may change. Each agency, clinic or operator sets its own criteria, interviews, tests, contracts, payments, expenses, insurance and schedules.
Tlacati does not decide whether a person is accepted or control third parties' medical, legal or administrative decisions. It therefore does not guarantee:
- Acceptance into or continued participation in a program.
- Pregnancy, birth, timelines, appointments or clinical outcomes.
- Compensation, payments, reimbursements, support or expenses.
- The arrangement, validity or scope of insurance and coverage.
- A third party's solvency, availability or performance of its obligations.
- Any immigration, family, civil, employment, tax or other legal outcome.
Before proceeding, ask the third party for all relevant conditions in writing, ask who bears each expense and seek independent advice when needed.
4. Referrals, links and third parties
A referral from Tlacati only facilitates contact. It does not make the agency, clinic, professional or operator an employee or representative of Tlacati, nor does it mean Tlacati controls their actions.
Third parties are responsible for their information, assessments, contracts, services, facilities, staff, payments and privacy measures. You should directly review their terms, privacy notice, legal identity, permits and credentials before providing documents, making payments or signing.
Links to WhatsApp, Facebook, Instagram and other sites are provided for convenience. When you open them, those platforms' rules and policies also apply.
5. Personal information and documents
Share only what is essential in a first conversation. Tlacati does not request or store documents or test results. Do not send INE identification, CURP, proof of address, records, diagnoses, medical test results, prescriptions, banking details or photographs of those documents.
If you would like Tlacati to prepare a descriptive profile or facilitate a referral, we will explain what information will be used and with whom it would be shared. The profile is shared only with your express permission. Personal data processing is governed by the Full privacy notice.
6. Responsible use of the site and channels
The site and guidance are intended for adults. By using them, you agree to:
- Provide information you believe to be true and not impersonate another person.
- Not send third parties' documents or data without their permission.
- Not use the channels to harass, threaten, discriminate, defraud or carry out unlawful activities.
- Not attempt to compromise, abusively automate, interfere with or extract content or data from the site.
- Not present Tlacati's content as medical or legal advice or a promise of an outcome.
Tlacati may limit or close a conversation in cases of abuse, risk to a person, unlawful activity or breach of these terms.
7. Emergencies
Tlacati does not provide emergency care or monitor its channels continuously. In a medical emergency, violence, immediate danger or crisis, call 911 or contact the emergency service or competent authority in your area.
8. Content and intellectual property
Tlacati's brand, logos, design, original text, illustrations and downloadable materials are protected by applicable law. You may read and download the materials provided for personal and informational use.
You may not sell them, claim them as your own, modify them to mislead, use the brand to imply a relationship with Tlacati or reproduce them commercially without written permission. Third-party brands and content belong to their respective owners.
9. Availability and scope of liability
Tlacati aims to keep information clear and reasonably current, but legal frameworks, program criteria and third-party services may change. The site provides general guidance and may contain errors, interruptions or information that is no longer current.
To the extent permitted by law, Tlacati is not liable for decisions made solely on the basis of general information on the site, or for the acts, omissions, services, promises or breaches of independent third parties. This provision does not exclude liability that cannot legally be limited or affect the non-waivable rights of consumers or personal data subjects.
10. Changes and termination
Tlacati may update the site and these terms to reflect operational, legal or security changes. The current version and its date will be published on this page. Changes apply upon publication unless the law requires another notice or consent.
You may stop using the site or end a conversation at any time. Tlacati may also suspend the site or a feature, while seeking not to affect privacy requests or rights already exercised.
11. Applicable law
These terms are interpreted under the federal laws of Mexico and, where applicable, those of Mexico City. We will first seek to resolve any disagreement in good faith in writing. This does not limit the right to approach the competent authority or court, or impose a jurisdiction different from that which legally protects the user.
If a provision is found invalid, the remaining provisions will continue to have effect to the extent permitted by law.
